Effective August 1, 2023 the monetary limit for claims brought before the Alberta Court of Justice (formerly the Provincial Court of Alberta) will increase from $50,000 to $100,000 pursuant to Order in Council 146/2023.
This means that as of August 1, 2023, claims in excess of $50,000 (but equal to or less than $100,000) that previously would have been required to be brought before the Alberta Court of King’s Bench to have their full value adjudicated, will be able to be brought before the Alberta Court of Justice.
This change will allow a greater amount of litigants to access the often more expedient and less costly Alberta Court of Justice.
Also notably, corporate litigants without a lawyer who would have previously been required to bring their claim before the Alberta Court of King’s Bench (and thus unable to represent their corporation in court) will now be able to bring their claim before the Alberta Court of Justice.
Litigants will also benefit from the Alberta Court of Justice’s simplified procedure and process compared to the Alberta Court of King’s Bench.
